Apple has been on Samsung’s tail in the patent battle that erupted in US and then went all over the globe. Both companies have sued and counter-sued each other multiple times and the fight is expected to go on for some time now. The patent battle begin with Apple suing Samsung for copying iPhone / iPad designs (boiling down to the product packing) and Samsung retaliated with its own suits. The case became a little messy with both Apple and Samsung demanding to see unreleased products from the opponent (Samsung was denied iPad3 & iPhone 5).
Recently we heard that Samsung had to delay the launch of Galaxy Tab 10.1 in Australia due to Apple’s lawsuit and here is a big one from EU, apparently Apple has got a preliminary injunction against Samsung in Germany. The Landgericht (district court) of Düsseldorf in Germany has supported Apple and the result happens to be a EU-wide ban on Samsung’s Galaxy Tab 10.1, until a final order is passed. An exception here is Netherlands, given that they have slightly different laws, Apple is fighting an independent case there.
The ban on Samsung Galaxy Tab is immediate in Germany given the preliminary injunction Apple has secured and other EU nations would comply as soon as Apple completes the proceedings in those individual countries. Samsung has a tough time ahead and given that they are the ones who have given best competition to iOS devices, for innovation sake, we hope a settlement happens soon.
