Ban on Original Samsung Galaxy Tab 10.1 Upheld in Düsseldorf, Germany

Well in a twist of tale, the higher regional court in Düsseldorf Germany has upheld the ban on the original Samsung Galaxy Tab 10.1 in Germany.

This effectively means that Samsung will not be able to sell the tablet anytime soon in Germany. While passing the verdict the court ruled that the Samsung tablet’s design is very similar to that of the Apple iPad registered with the Community Design.

The ban also extends on the Galaxy Tab 8.9 and it can’t be appealed either as per a spokesperson at the court. A spokeswoman with Samsung has stated that though they are disappointed with the decision, it will not have much of an impact on the firm’s tablet sales as the Galaxy tab 10.1N which is a slightly modified version of the Tab 10.1 was earlier cleared by the authorities for sale in Germany.

Apple had tried to get the Galaxy Tab 10.1N blocked as well, but the same was cleared by a judge at the district court in Düsseldorf.

A final verdict on the ruling will be announced on the 9th of February and Samsung will have the option to appeal against it.

After Samsung had managed to clear the injunctions against the Galaxy Tab 10.1 in Australia and the Netherlands it was widely expected that the higher regional court in Düsseldorf will also pass a ruling in Samsung’s favor.
