Samsung Seeks To Nullify Patent Infringement Charges For 14 Of Its Devices

After 14 of the Samsung’s 23 products that were initially rules as infringing patents were considered for a review and the $450 million penalty put on hold by Judge Koh, Samsung is now trying to nullify charges against those devices. Samsung is requesting the US courts to reanalyse the judgement and see if the charges can be totally waived off as it feels that it never infringed upon Apple’s patents in the first place. Meanwhile Apple is trying to push for a management conference and near-term damages trial for April 3rd to get some immediate results from the judgement given last year. As per the initial judgement, Samsung is supposed to shell out an amount of $1.05 billion to Apple for patent infringements.

Samsung is now asking the courts to increase the page limit for its response towards the judgement claiming that a chance in Jury’s judgement will compel Samsung to provide more details and determine whether the products actually infringe the patents or not. Samsung is trying every way to further delay the final judgement, it now requested Judge Koh to grant Apple its request for a partial final judgement so that Samsung can file an immediate appeal against that decision.

Apple meanwhile is hell bent on getting Samsung’s products to be banned from US shores once proven that they indeed infringe upon Apple patents. In an official statement Samsung said the following

If the Court declines to enter the partial final judgment and stay that Samsung has requested, and instead sets the case for immediate new trial, the Seventh Amendment would require that the new jury retry certain liability issues along with the damages issues that are subject to the Court’s new trial order.
